Terms of Service

These Terms of Service ("Terms") govern your access to and use of WorkSiteCam, including our mobile apps, web app, and website (collectively, the "Service"), operated by Investoy Software Inc. ("WorkSiteCam," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The service
WorkSiteCam helps contractors capture, organize, and share job-site photos and related project documentation, and to optionally sync that information with third-party tools you connect.
Accounts
You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old and authorized to act on behalf of your business to use the Service.
Free trials, subscriptions, and billing
The Service is offered on free and paid subscription plans. Free trials convert to a paid subscription unless cancelled before the trial ends. Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. We may change pricing on a prospective basis with notice.
Acceptable use
You agree not to: misuse or interfere with the Service; attempt to access it by unauthorized means; upload unlawful, infringing, or harmful content; or use the Service to violate the rights of others or any applicable law. You are responsible for obtaining any consents needed to capture and upload photos taken at a job site.
Your content
You retain ownership of the photos, project data, and other content you submit ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service and to provide features you enable (including syncing to third-party services you connect). You are responsible for Your Content and for maintaining your own backups.
Third-party integrations
The Service can connect to third-party products (such as cloud storage, calendars, and CRMs) at your direction. Your use of those products is governed by their own terms and privacy policies. We are not responsible for third-party services, and your authorization can be revoked at any time from your account settings or the third party.
Intellectual property
The Service, including its software, design, and trademarks, is owned by WorkSiteCam and its licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost.
Limitation of liability
To the maximum extent permitted by law, WorkSiteCam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the twelve months before the claim.
Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Upon termination, your right to use the Service ends; certain provisions survive termination by their nature.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where prohibited by applicable law.
